Cargo Aircraft are still exempted from FAR 135.411(a)(2) maintenance requirements

The FAA has apparently decided to consider aircraft utilization rather than its type certificate when determining the applicable maintenance program. In 2004, the FAA proposed changes to the flight standards handbook bulletin for airworthiness that would have required aircraft type-certified for more than 10 passengers to be operated under a FAR 135.411(a)(2) program. With its recent announcment, the FAA has apparently agreed to allow aircraft type-certificated for nine or more passengers but configured as cargo aircraft with fewer than 9 passenger seats to comply with a FAR 135.411(a)(1) maintenance program.
