Judge grants rare Temporary Injunction to Scott Burgess and Charles Morgenstein
by Aviation Legal Group Editor, released on Monday November 22, 2004
A Judge in Central Florida granted a rare Temporary Injunction (without prior notice to the Defendant) to an Aircraft Lender represented by Scott Burgess and Charles Morgenstein, which had the effect of freezing all of the bank accounts of the owner of an FBO who had purchased numerous aircraft financed by our client. The aircraft had been damaged in Florida's hurricanes, and the FBO owner improperly diverted insurance company checks totalling nearly US$750,000.00, which had been issued in joint names to the insured and to the lender, so that the lender could repair its collateral. On less than one business-day's notice, Scott and Charlie drafted the vouminous and technical documents required to obtain the Injunction and supervised the process until it was served on the Defendant. Within a few days, the diverted funds were returned to the Lender.
