Appellate Court Affirms Summary Judgment obtained by Scott Burgess
by Aviation Legal Group Editor, released on Tuesday November 16, 2004

After an aircraft manufacturer purchased one of its oldest aircraft and donated it to the Smithsonian Institution, the Seller sought to rescind the sale, claiming that the Seller's representatives were not authorized to complete the sale. Using the Seller's own testimony against him, Scott Burgess was able to convince the trial court to enter summary judgment in favor of the aircraft manufacturer. The Seller appealed and, following oral argument, the Fourth District Court of Appeal affirmed Final Summary Judgment in favor of the aircraft manufacturer.
