Financing and Loan Securitization
Aviation Legal Group has experience with both domestic and international financing and loan securitization issues. Regardless of where you are based, our attorneys can assist you with your aviation financial requirements.
Refinancing
Occasionally, it makes sense for our clients to consider refinancing an existing aircraft loan. We keep abreast of legal and tax considerations worldwide that could assist our clients in obtaining the most favorable financing available. We can review your current loan to make sure that it is well-suited to your needs, and recommend alternatives accordingly.
Outright Purchase
We can assist an aircraft purchaser in negotiating the loan documents, selecting a venue for maximum cost savings on delivery, deciding where to register the aircraft, and determining the form and venue of the entity which will own the aircraft and the entity which will operate the aircraft.
United States of America (Domestic)
We assist aviation lenders and borrowers in accomplishing their financing objectives. When representing borrowers, we are well qualified to assist with the selection of the lender and lending structure (e.g., mortgage or synthetic lease) that best suit the borrower's needs. When representing the lender, we assist with selection of the lending structure and draft documentation to best protect the lender's investment and security interest in the aircraft.
Capetown Convention
The Capetown Convention is an exciting development for aircraft owners and lenders, in that it may establish a global registry of interests against aircraft title, providing lenders the confidence necessary to expand the geographical boundaries acceptable to loan underwriters.
Commonwealth of the Bahamas
We have successfully and efficiently secured loans with Bahamian-registered transport aircraft for a U.S.-based lender and, in the process, forged a strong relationship with the Bahamian CAA.
Dominican Republic
We successfully and efficiently secure loans for Dominican-registered transport aircraft for international lenders and, in the process, forged a strong relationship with the Dominican DGAC.
Jamaica
We maintain ongoing relationships with Jamaican attorneys and government officials to help cut through the red tape that can sometimes make simple transactions more expensive and more time consuming than they need to be.
United Mexican States
We successfully and efficiently secured loans with Mexican-registered corporate aircraft for a U.S.-based lender and, in the process, forged a strong relationship with Mexico's DGAC.
Bolivarian Republic of Venezuela
During pre-Chávez administrations, we successfully and efficiently secured loans with Venezuelan-registered transport and corporate aircraft for U.S.-based lenders and, in the process, forged a strong relationship with the Venezuelan INAC.
